1. Terms

By using our website, app or other services, you agree to be bound by these terms and all applicable laws and regulations. You alone are responsible for your actions and for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site.

The materials contained in the Enchanted Moon Academy(EMA) website and courses, Paths and Streams are protected by applicable copyright and trademark law. They are the intellectual property of the individuals who wrote the materials and are to be used for personal, private, educational purposes only.

2. Use License

Permission is granted to download one copy of any downloadable materials on EMA’s lesson platform for personal, non-commercial use only. This is the grant of a license, not a transfer of title, and under this license you may not: modify or copy the materials; use the materials for any commercial purpose, or for any public display (commercial or non-commercial); attempt to decompile or reverse engineer any software contained on the EMA’s website and lesson platform remove any copyright or other proprietary notations from the materials; or transfer the materials to another person or `mirror' the materials on any other server. Multiple students must enrol under individual registrations.

This license shall automatically terminate if you violate any of these restrictions and may be terminated by EMA at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format. As per above - this license is for single student, personal educational use only.

3. Disclaimer

The materials on the EMA’s website are provided for educational and entertainment purposes only . EMA makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, EMA does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.

4. Limitations

In no event shall EMA be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on the EMA website or lesson platform, even if EMA or an authorized personnel of EMA has been notified orally or in writing of the possibility of such damage. Any action you take upon the information found on this website and our lesson platform is strictly at your own risk.

5. Revisions and Errors

The materials appearing on EMA's website and lesson platform may include technical, typographical, or photographic errors. The authors of the courses do strive to be as accurate, complete and current as possible but EMA does not warrant that any of the materials on its sites are accurate, complete, or current. EMA reserves the right to cancel, interrupt, reschedule, or modify any content, or change the point value or weight of any assessment at any time.

6. Links

The Academy has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement of the site by the EMA. Use of any such linked websites is at the user's own risk.

7. Refunds & Returns

Eligible purchases can be exchanged within 14 days of purchase for another course of your choosing of equal or lower value, or refunded (less processing fees) with the exception of the Path courses and Streams which are non refundable.

Exchange

We want to provide you with the best learning experience possible. Sometimes we understand the course you selected isn’t quite what was expected, eligible purchases can be exchanged within 14 days of purchase for another course up to the value of your original purpose at the discretion of the EMA.

Refund

In cases where an exchange is declined, a refund will be granted back to the payment method used, this will be less any processing fees deducted by third parties, and provided it otherwise meets our 14-day refund policy.

Please allow up to 30 days for any money to be returned back to your account. Your statutory rights are not affected. Refunds will be returned to the card used for the original purchase. Access to your course will be deactivated and removed.

We reserve the right, in our sole discretion, to determine the eligibility of the refund/exchange request or deny refund/exchange requests in cases where we believe there is refund/exchange abuse, including but not limited to the following:

More than two modules of the course has been consumed or studied by a student before the refund was requested.
Multiple refunds have been requested by a student for the same course.
Excessive refunds have been requested by a student.
Students who have their account blocked or course access restricted due to a violation of our terms.

8. Security

While we have safeguards and work to protect the security of your account and related information, EMA cannot guarantee that unauthorised third parties will not be able to defeat our security measures. Please notify us immediately of any compromise or unauthorised use of your account.

9. Site Terms of Use Modifications

EMA may revise these Terms & Conditions for its website, apps, and other products and services at any time without notice. By using this website you are agreeing to be bound by the then current version of these Terms & Conditions.
